These My Champions Club Terms and Conditions apply to individuals who join as members of the My Champions Club Loyalty Program (you, your) operated by Hygain Holdings Pty Ltd and its related companies (in these terms, Hygain Group).
By participating in the My Champions Club, including by scanning a QR code and applying for and being issued with points, individuals acknowledge that they have read, understood and agree to be bound by these Terms and Conditions.
ELIGIBILITY
1. My Champions Club Loyalty Program is available to individuals who are Australian or New Zealand residents and are aged 16 years or older. Hygain Group has the discretion to refuse any application for membership in its discretion.
2. You can apply for and establish membership of My Champions Club by scanning your first QR code and completing your First Name, Last Name, Mobile, Email and Password. This will also establish an account on Hygain.com.au or Mitavite.com online stores where accounts do not already exist for the email address provided. My Champions Club points are automatically sent to the Member’s Hygain or Mitavite account, depending on the brand of the item scanned.
PRIVACY
3. Hygain Group (or agents acting on its behalf) collects personal information in accordance with the Hygain Privacy Policy. Our Privacy Policy forms part of these Terms and Conditions.
4. By providing your personal information, you consent to its use and disclosure in accordance with the Privacy Policy, including for administering the My Champions Club Program, managing points and other benefits, and for ongoing communication and marketing to My Champions Club Members. You agree that we may provide certain of your personal information to service providers, contractors and agents engaged by us for the purpose of administering My Champions Club
5. By providing your details through QR scans, you consent to your personal information being used and disclosed for the purposes of direct marketing of goods and services. Direct marketing communications may be made by email, SMS, push notifications, social media, or by regular post. You can “opt out” at any time by emailing enquiries@mychampionsclub.com.au, calling (03) 5943 2255, or clicking the unsubscribe link in the marketing communication.
POINTS SYSTEM
6. My Champions Club members will accrue points only on in-store or online purchases of selected branded Hygain and Mitavite products where products have My Champions Club QR codes on packaging. QR codes scanned after the final points accrual date (as set by Hygain Group if the program is paused or discontinued) will not generate points.
7. Points are not transferable, are not redeemable for cash, and have no monetary value.
8. Points are set for each product individually and cannot be claimed retrospectively. Any returned goods will result in points for the returned goods being reversed or cancelled. Points may be adjusted up or down in the event of incorrect accrual, or if it is identified that a QR scan was made without a qualifying purchase.
9. Every new My Champions Club member receives 100 points for signing up.
PROGRAM PAUSE AND WIND DOWN
10. Hygain Group may pause, suspend, wind down or discontinue the My Champions Club Loyalty Program at any time.
11. If the Program is paused or discontinued, Hygain Group may determine:
a. a final date after which no further points can be earned; and
b. a final redemption period during which Members may redeem any points remaining in their account.
12. Members will be notified of any Program pause or wind down via email, website notice, or other communication.
POINTS BY PRODUCT
13. My Champions Club reserves the right to amend or vary the list of products and/or the allocation of points to products from time to time in its sole discretion.
14. In the event the Program is paused, wound down, or discontinued, Hygain Group may specify a final redemption period during which Members may redeem any points remaining in their account.
15. After the expiry of the final redemption period, any unused points will automatically expire and will no longer be redeemable.
POINTS REDEMPTION
16. Points are redeemable only through online vouchers. Redemption is provided by an online checkout code to convert points to dollars, which may be used to purchase supplements or merchandise from Hygain.com.au or Mitavite.com.au online stores only.
17. Points cannot be redeemed from any retail store.
18. My Champions Club points will expire automatically after 2 years starting from the date the relevant QR code was scanned, unless otherwise specified in a final redemption period under a Program pause or wind down.
19. Points can only be redeemed by the Member personally through their online Hygain or Mitavite account. Points are not transferable and are not redeemable for cash or other value, including gift cards.
20. Hygain Group may make other benefits and rewards available to Members, such as Birthday Offers. These offers may be changed or substituted from time to time and will expire based on the offer period. Offers are not transferable, redeemable for cash, and cannot be used in conjunction with any other offer.

TERMINATION
22. Hygain Group may terminate your participation in My Champions Club immediately if you breach any Terms and Conditions, act illegally, fraudulently, or in a manner that may bring us into disrepute. Termination may result in cancellation of points accrued or which would have accrued under the Program.
23. Hygain Group may cancel or amend My Champions Club and/or these Terms and Conditions, including adding, removing, or changing available products and/or points. Points and/or redemption offers accrued prior to the effective date of any pause, suspension, or termination must be redeemed during the final redemption period specified by Hygain Group. After this period, all unused points will expire and will no longer be redeemable.
LIABILITY
24. To the extent permitted by law, Hygain Group is not liable for any loss or damage related to My Champions Club membership, including:
a. your account, points, or the website/app;
b. any suspension or termination of the Program;
c. disruption or unavailability of the Program;
d. product availability;
e. fraudulent use, misuse, or misappropriation of your account; or
f. any indirect or consequential loss arising from participation or points usage.
25. Hygain Group will not be liable for delays or inability to provide Program benefits caused by circumstances beyond our control, including but not limited to acts of God, weather, strikes, or industrial disputes.
26. Where liability cannot be excluded by law, it is limited to the value of points accrued in the Member’s account in terms of redemption for supplements or merchandise within any applicable redemption period.
27. Any dispute regarding the Program, points, or eligibility will be determined by Hygain Group acting reasonably.
VARIATIONS
28. We may change these Terms and Conditions, including:
a. varying how points are calculated and earned;
b. introducing a cap on points;
c. establishing additional ways to earn points;
d. cancelling recognised ways to earn points.
29. If a change is likely to:
a. benefit you or have a minor impact, it may be made immediately by publishing on www.mychampionsclub.com; or
b. have a significant detrimental impact, changes will be made no sooner than 10 days after notifying Members via email.
30. If you do not accept a change:
a. you may close your account by emailing enquiries@mychampionsclub.com.au; and
b. you should indicate whether you wish to spend or forfeit remaining points.
GENERAL
31. These Terms and My Champions Club are governed by the laws of Victoria, Australia, and parties submit to the exclusive jurisdiction of the courts of Victoria.
32. You must not assign, transfer, subcontract, or otherwise deal with rights and obligations under these Terms without prior written consent from Hygain Group.
33. If any provision is invalid, void, illegal, or unenforceable, it may be severed and remaining provisions remain in force.
34. Failure to enforce any provision does not constitute a waiver and does not affect the right to enforce that provision later.
35. In these Terms:
a. clause and paragraph headings are for convenience and do not affect interpretation;
b. singular includes plural and vice versa;
c. defined words carry corresponding forms;
d. references to legislation include amendments, replacements, or re-enactments;
e. general words are not limited by examples.
